Don't Say "Hello," Say "I Listen to JACK" – Official Rules
1. The "Don't say Hello, Say I Listen to JACK" Contest of 100.7 JACK FM/ Midwest Television in San Diego, (the "Contest") will run September 3rd through September 27th (the "Term"), although the Station may in its discretion limit, extend, eliminate or change the Term of the Contest.
2. During the Term of the Contest the Station will give away up to 36 prizes of up to $100.00 along with other yet to be determined non-cash prizes to contestants that successfully meet the Contest criteria set out in these rules.
3. No purchase is required nor is the payment of any other consideration to the Station to be eligible to win a prize in the Contest. Estimated retail value of the prizes is $100.
4. Contestants will be chosen from entries sent to www.sandiegojack.com. Listeners with unlisted phone numbers or unlisted cell phone numbers may voluntarily submit their name and phone number via email to radiopromotions@kfmb.com, or via mail to "I Listen To JACK" c/o Radio Promotions, 7677 Engineer Rd, San Diego, CA 92111 to be eligible for the contest. The Station may use any method they so determine random for selecting the contestants at random.
5. Persons employed by the Station, prize sponsors, and their immediate families (brothers, sisters, children, mother, father, spouse including a common law spouse or those who have resided in their domicile for a period of more than 6 months) are ineligible to participate in the Contest.
6. The person answering the phone must be over 18 years of age or someone else present in the household at the time of the call may become the contestant (the "Contestant"), at the option of the station.
7. To be eligible to win a prize in the Contest the Contestant will have to answer the phone, or be in the house when the phone is answered by an ineligible contestant and answer the phone with "I LISTEN TO JACK". No variation in the Phrase will be accepted. The decision as to whether the Phrase has been correctly recited rests solely with the Station's on-air announcer and his or her producer. All decisions are final.
8. If the Contestant does not answer the telephone with "I LISTEN TO JACK", they do not win the prize.
9. If the Contestant properly recites "I LISTEN TO JACK" he or she will win the prize being given away during that call, subject to the following:
a) Correctly answering a skill testing question;
b) Signing a declaration confirming compliance with the rules of the Contest and acceptance of the prize awarded;
c) Agreeing to indemnify and to save harmless the Station, its officers, directors, subsidiaries and affiliates for any costs, damage, expense or other injury arising out of or related to the awarding, recipient use of the prize or on account of any false information given to the Station by the Contestant;
d) Consenting to the publication and/or broadcast of the winner's name, picture, address, oral statements or responses without compensation other than the awarding of the prize.
10. Only on-air announcer will make all calls during their program and between the hours of 3:00 pm and 7:00 pm, Tuesday through Friday from September 3rd through September 6th, Monday – Friday September 9th through September 13th, Monday – Friday September 16th through September 20th, and Monday – Friday September 23rd through September 27th. No other calls from the Station will make anyone eligible to win the Contest.
11. All calls will be made off air and will be recorded for on-air, providing the Contestant or any other person recorded consents.
12. If the radio announcer mistakenly dials a number different from that chosen at random or otherwise reaches a different person, persons, family or residence then that announced then the person answering the number dialed will be the Contestant. The Station will not be responsible or liable to any person or persons whose name and or number is announced but who do not receive the call as announced.
13. If when placing a call to the randomly chosen number the line is busy or not in service then a new number will be selected and called at a later time.
14. When placing a call the announcer will let the phone ring a minimum of three times before hanging up.
15. If when placing a call the phone is answered by an answering machine or service then if the message recorded and repeated by the answering machine or service is “I LISTEN TO JACK”, then the Contestant and winner will be the person or persons whose voice or voices are recorded on the machine. Where the recording is of more than one person the prize will be split evenly amongst those persons. The winners will have to show to the Station’s satisfaction that they are the person or persons on the recording. The Station reserves the right to make the final decision on the identity of the winner or winners.
16. The Station requires proof of the identity and entitlement of any winner.
17. All Contestants agree to be bound by the rules of the Contest and any decision made by the Station concerning the contest.
18. These rules are available:
a) on the web site as of August 30th 2013
b) by self addressed stamped return envelope or at the station
19. All the Station announcers and others directly involved in the Contest have agreed that they will not willingly or knowingly give any prize away in contravention of these rules.
20. If a circumstance arises that is not covered by these rules the Station will be the final arbiter of any dispute and its decision will be final and not reviewable by any Court or Tribunal.
21. Chances of winning depend upon number of telephone book entries and unlisted phone number and cell phone numbers received via email, and knowledge of answering the phone with “I LISTEN TO JACK”.
22. The Contest is subject to all applicable Federal, and State laws.
23. If a circumstance arises that is not covered by these rules, or if any question or dispute arises under these rules or related to the contest, the contest judges will be the final arbiters of any dispute and decision will be final and not reviewable by any Court or Tribunal.
24. The Station reserves the right to discontinue, withdraws, or modify the contest, in whole or in part, at any time, without prior public notice.
25. Prizes given away are 'as is' and Sponsor shall not be held liable for failure of a participating sponsor(s) to deliver said prizes.
27. Prizes are non refundable and nontransferable.
28. All state local and federal taxes are the sole responsibility of the winner(s).
29. Winner(s) agree that their likeness, name, photo and/or voice may be used for promotional purpose by 100.7 JACK FM/ Midwest Television and/or it's participating sponsors free of compensation.
30. All information acquired during contesting will become the sole property of Midwest Television, and will be destroyed or securely stored at our facility.
31. Certain events may require participant(s) to sign waiver documentation releasing 100.7 JACK FM of any and all liability that may be incurred due to bodily injury, loss of income, employment or any and all other extenuating circumstances that may result from participating in the event.
32. 100.7 JACK FM may terminate a contest(s) at anytime with no prior written or vocal notice. In the event of any tie, a random drawing will be held to determine a sole winner(s). Any person and or persons who use fraudulent means to win a prize(s) will be disqualified from any and all current or future promotions, and at the discretion of Sponsor, legal action may ensue.
33. Violation of any of the above rules will result in immediate forfeiture of all prize(s) and may result in a permanent ban on participating in any future promotional events by 100.7 JACK FM and its participating sponsors.
